Einleitung Zum Erbrecht; 1922-1966 : (Erbfolge) (9783805910552)



Die Neubearbeitung der Einleitung zum Erbrecht berücksichtigt bereits die bevorstehende Reform des Erb- und Verjährungsrechts und würdigt u. a. die verfassungsgerichtliche Rechtsprechung zur Testierfreiheit (Hohenzollern) und zum Pflichtteilsrecht und gibt Hinweise auf die europarechtliche Entwicklung im Erbrecht.

Schwerpunkte der Kommentierung des § 1922 sind die Schnittstellen von Erbrecht und Gesellschaftsrecht und die Rechtsnachfolge in öffentlich-rechtliche Positionen. Ebenfalls schon berücksichtigt wurde die wichtige Grundsatzentscheidung des BFH vom 17.12.2007, in der die Vererbbarkeit des Verlustvortrags bestätigt wird. Bei der gesetzlichen Erbfolge wird auch die Erbfolge nach dem Lebenspartnerschaftsgesetz dargestellt. Im Zusammenhang mit dem Ausschlagungsrecht wird die neuere Rechtsprechung zum sozialhilferechtlichen Überleitungsrecht berücksichtigt. Erläutert wird auch das neue Vergütungsrecht für den Nachlasspfleger.
